Lee County (Florida) State Attorney Uses Criminal Extortion Tactics And Violates the Constitution

Not only has Miller conspired with Lee County judges and his colleagues in the State Attorney’s Office to file false trumped up charges against me, he even conspired with my court-appointed attorney, Sebouh Gourjian, using threats and extortion in abusing his power. on July 19, 2017, prior to a scheduled hearing in the case, my attorney, Mr. Gourjian, handed me a printed email from James Miller sent earlier that morning, and advised me that was the state’s offer.
The email offer was 20 years in prison with 5 years probation, with a clause that I could not file court documents without an attoney, a clear violation of my rights. Gourjian refused to exlain or have any further discuss with me about this ridiculous offer, as he is required to do. The only crime I’ve ever been convicted of in my life is a DWAI (Driving While Ability Impaired) in 1991, shortly after turning 18. Twenty-six years later I’m being treated like a violent criminal when I have done nothing wrong. All because the Lee County Clerk of Court and her judges have a personal vendetta to settle, and are using their own court system to do it. This obvious conflict of interest is corruption at its highest level.
Now for the extortion…Miller’s email threatens to add additional trumped up charges against me and to arrest my wife should I refuse his offer. This violates Florida Statute 836.05 – Threats/Extortion; The law states as follows: “Whoever, either verbally or by a written or printed communication, maliciously threatens to accuse another of any crime or offense, or by such communication, maliciously threatens an injury to the person, property or reputation of another, or to impute any deformity or lack of chastity to another, with intent to extort money, or pecuniory advantage whatsoever, or with intent to compel the person so threatened, or any other person, to do any act or refrain from doing any act against his or her will, shall be guilty of a felony of the second degree.”
James Millers’ extortion offer also violates the United States and Florida contitutions by denying me due process and right to court access. Right of access to the courts is basic to our system of government and is one of the fundamental rights protected by the constitution. U.S.C.A. Const. Art 4, Section 2, Clause 1; Amendment 5 and 14. “A single act of depriving a citizen of his right to correspond simlutaneously constitute a violation of subtantive constitutional rights and of the right to procedural due process. Because the right to correspond is protected by the First and Fourteenth Amendments, the result of depriving a citizen of this right will violate those substantive guarantees unless the action is justified by compelling countervailing state interests. Ryaland v Shapiro, 708 F.2d 967 (1983). Fourteenth Amendment, the manner in depriving a citizen of this right could violate the procedural norms emobodied in the Due Proces Clause. See Procunier v Martinez, 416 U.S. 396, 945 Ct. 180, 40 L.Ed. 2d 224 (1973). The due process clause has also been construed to allow prisoners meaningful access to the courts. See Bounds v Smith, 430 U.S. 817, 975, S. Ct. 1491, 52 L.Ed. 2d 72 (1977); Boddie v Connecticut, 401 U.S. 371, 91 S. Ct. 780, 28 L.Ed @d 113 (1971).
What do you do when you’re attacked by judges and a court clerk in their own court? They are above the law and nobody seems to care, or is too afraid to do anything. Despite the extortion in writing by state prosecutor James Miller, the trial judge Margaret O. Steinbeck continues to sing his praises. His colleagues have even perjured themselves in sworn statements, and justice seems impossible. Any advise from an honest attorney is greatly welcomed. I’ve been left with no option except to represent myself in order to properly defend myself and file pretrial motions court-appointed counsel (Sebouh Gourjian) has refused to do. It is scary to have the court, judges, state attorney and attorney general against you in a venue they are controlling and manipulating!
